29 CFR 1910.23(b)(9): The employer did not ensure that ladders are inspected before initial use in each work shift, and more frequently as necessary, to identify any visible defects that could cause employee injury. On or about August 31, 2021, the employer did not inspect the safe working condition of the portable ladder/stair that is used to reach product off storage racks. The ladder/stair in use had damaged and bent lower horizontal bracing and bent vertical corner upright reducing the structural integrity and safe working capacity of the ladder/stair.

29 CFR 1910.178(g)(2):Facilities were not provided for flushing and neutralizing spilled electrolyte, for fire protection, for protecting charging apparatus from damage by trucks, and/or for adequate ventilation for dispersal of fumes: On or about August 31, 2021, the employer failed to ensure that flushing solutions and/or stations were made available to employees who may be exposed to powered industrial vehicles battery fluids when batteries are changed out, fluids topped off or and accidental leakage of fluids occur. At the time of the inspection, there was a two pack of eye flushing solution handing on the wall in the front of the warehouse that was opened, half full and expired in 2002.

A Crown stand up vehicle, #6, serial #1A148655, was fond to have an overhead light that was broken and hanging by its wires from its socket near where the operator stands when operating the vehicles.
