29 CFR  1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:   a) Robert Harmon's Roofing on or about September 29, 2021, at the address of 9636 Montauk Sylvania, OH: The employer did not ensure the side rails of the aluminum extension ladder used on-site to access the roof extended at least three feet above the landing surface. Employees in this condition were exposed to falls of 13 ft.

29 CFR  1926.501(b)(13): Employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system or personal fall arrest systems.   a) Robert Harmon's Roofing on or about September 29, 2021, at the address of 9636 Montauk Sylvania, OH: The employer did not ensure employees were protected from falls while installing new roofing materials (asphalt shingles) to the roof of a residential type structure.  The employees were exposed to a potential 24 foot fall to the level below.  Robert Harmon's Roofing was previously cited for a violation of an equivalent Occupational Safety and Health standard 1926.501(b)(13) which was contained in OSHA inspection number 1407979 citation number 1, item number 1 and was affirmed as a final order on August 14, 2019 with respect to a workplace located at 8553 Mackinac Street in Sylvania, OH.  Robert Harmon's Roofing was previously cited for a violation of an equivalent Occupational Safety and Health standard 1926.501(b)(13) which was contained in OSHA inspection number 1288561 citation number 1, item number 1 and was affirmed as a final order on February 21, 2018 with respect to a workplace located at 3824 Sanibel, Sylvania, OH.
