29 CFR  1910.95(c)(1):The employer failed to administer an effective hearing conservation program when employee noise exposures equaled or exceeded an 8-hour time-weighted average (TWA) sound level of 85 decibels measured on the A scale (slow response), or equivalently a dose of fifty percent.  On or about October 13, 2021, the employer at Durable Corporation located at 75 North Pleasant Street in Norwalk, Ohio 44857 did not develop or maintain an effective hearing conservation program which included audiometric testing, retention of noise exposure measurements, and training for employees that conduct job operations that include exposure to noise over 85 dba. One Steel Press Operator was sampled for 456 minutes for an 8-hour time-weighted-average of 92.3 decibels on the A weighted scale. The Second Steel Press Operator was sampled for 432 minutes for an 8-hour time-weighted-average of 92.6 decibels on the A weighted scale.

29 CFR  1910.253(b)(2)(ii): The employer failed to store pressurized tanks of oxygen in a well-protected, well-ventilated, dry location, at least 20 (6.1 m) feet from highly combustible materials such as oil or excelsior. Assigned storage spaces were not located where cylinders will not be knocked over or damaged by passing or falling objects, or subject to tampering by unauthorized persons.   On or about October 13, 2021, the employer at Durable Corporation located at 75 North Pleasant Street in Norwalk, Ohio 44857 did not properly store or maintain pressurized tanks for workplace operations. The employers stored pressurized tanks labelled as oxidizers next to pressurized tanks that were labelled pressurized gas and flammables. These gases are used for work operations such as welding and operating machinery which includes but not limited to Compressed Gas, N.O.S., Propylene, and Oxygen. This improper storage can expose employees to fire/explosion hazards.

On or about October 13, 2021, the employer at Durable Corporation located at 75 North Pleasant Street in Norwalk, Ohio 44857 did not develop, implement, or maintain a detailed hazard communication program about the hazardous chemicals in the products they use in their work stations including but not limited to Toluene, Methanol, Acetone, Xylene, and Propane gas. This can expose employees to health or physical hazards in the event of mishandling chemicals they are working with.

29 CFR  1910.1200(f)(6)(ii): The employer did not ensure that each container containing hazardous chemicals in the workplace was properly labeled, tagged, or marked with a product identifier and words, pictures, symbols, or combination thereof, which provide at least general information regarding the hazards of the chemicals, and which, in conjunction with the other information immediately available to employees under the hazard communication program, will provide employees with the specific information regarding the physical and health hazards of the hazardous chemical.  On or about October 13, 2021, the employer at Durable Corporation located at 75 North Pleasant Street in Norwalk, Ohio 44857 did not develop, implement, or maintain labels or product identifiers for hazardous chemicals used in normal workplace production and operations including but not limited to Toluene, Methanol, Acetone, and Xylene. The lack of labeling can expose employees to health or physical hazards they might not be aware of in the event of an exposure.

29 CFR  1910.1200(h)(1): Employers failed to provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new chemical hazard the employees have not previously been trained about is introduced into their work area. Information and training may be designed to cover categories of hazards (e.g., flammability, carcinogenicity) or specific chemicals. Chemical-specific information must always be available through labels and safety data sheets.  On or about October 13, 2021, the employer at Durable Corporation located at 75 North Pleasant Street in Norwalk, Ohio 44857 did not instruct or train employees on how to handle products in operations that include the use of products that contain hazardous chemicals that are flammable and toxic including but not limited to Toluene, Methanol, Acetone, Xylene, and Propane gas. Without training it can make it more difficult for employees to identify hazardous chemicals and increase the chances of their exposure to serious health or physical hazards from said chemical.
