29 CFR 1910.38(b): An emergency action plan was not in writing, kept in the workplace, and available to employees for review: On or about October 6, 2021, the employer did not instruct all employees in the recognition and avoidance of unsafe conditions. The employer did not have a written emergency action plan and employees working at a construction site were not instructed in the emergency action plan and what to do in case of evacuation due to carbon monoxide alarms.

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: On or about October 20, 2021, the employer failed to implement a hazard communication program to all affected employees. Employees were assigned work assignments in facilities where subcontractor employees were using propane and diesel fuel in the common areas generating carbon monoxide and employees were not made aware of the hazards.

29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area: On or about October 20, 2021, the employer failed to train employees on the hazards of chemicals they may be exposed to or work with, including, but not limited to, propane and diesel fuel. Propane tanks and diesel fuel are used to power the forklifts, welders, and aerial lifts, and employees are exposed to fumes from combustion in the common work areas.
