29 CFR  1910.28(b)(1)(i):29 CFR 1910.28(b)(1)(i):  Except as provided elsewhere in this section 29 CFR 1910.28, the employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the systems described in 29 CFR 1910.28(b)(1)(i):  a) Huck's Pallets LLC located at 3810 Tick Ridge Road VINCENT, OH 45784:  On and preceding November 9, 2021, the employer did not ensure that employees working at heights exceeding 4 feet were protected from falls.  Employees were tasked with emptying a dust bin/collector in to a dump truck while standing on the frame crossbracing for the dust collector that was 7 feet or more above the ground.  While standing on the crossbracing,  employees would pull open a sliding gate at the bottom of the dust bin, used a rod to jab inside the chute to dislodge dust and close the gate as needed.  No means of fall protection was provided to protect employees thereby exposing them to falls exceeding 7 feet.

29 CFR  1910.212(a)(3)(ii): Point(s) of operation of machinery were not guarded to prevent employee(s) from having any part of their body in the danger zone(s) during operating cycle(s):    a) Huck's Pallets LLC located at 3810 Tick Ridge Road VINCENT, OH 45784:  On and preceding November 9, 2021,  the employer did not ensure that point of operation guards were in place on the Pendu and Wood-Mizer Pallet dismantlers to prevent the operator from contacting the blade during the operating cycle.  Operators dismantle 48 inch wide pallets using the 60 inch wide horizontal bandsaw blades on both pallet dismantlers.  A 12 inch section of unused blade was exposed during this operating cycle which exposed employees to struck-by hazards to the fingers and hands.

29 CFR  1910.213(r)(4): Suitable guard(s) were not provided to reduce to a minimum the hazard due to the point of operation of a large chop saw:   a) Huck's Pallets LLC located at 3810 Tick Ridge Road VINCENT, OH 45784:  On and preceding November 9, 2021, the employer did not ensure that point of operation guards on a chop saw were constructed as to prevent the operator from contacting the blade during the operating cycle.  A saw referred to as the big chop saw had guards on each side of the blade modified to accommodate larger wooden materials which exposed the blade during cutting of smaller wooden materials and in-between cuts when no workpiece was in place.  The following condition exposed employees to struck-by hazards while the saw is in operation.

Huck's Pallets LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard (name previously cited standard), which was contained in OSHA inspection number 1456566, citation number 1, item number 1 and was affirmed as a final order on February 28, 2020, with respect to a workplace located at 3810 Tick Ridge Road VINCENT, OH 45784.
