29 CFR  1910.95(d)(1): When information indicates that any employee's exposure may equal or exceed an 8-hour time-weighted average of 85 decibels, the employer shall develop and implement a monitoring program.   a)   Huck's Pallet LLC, at the jobsite located at 3810 Tick Ridge road, Vincent, Ohio 45784: On and/or preceding January 6, 2022, the employer failed to develop and implement a monitoring program for an employee exposed at or above an 8-hour time-weighted average of 85 decibels. An employee operating the morgan saw was exposed to continuous noise at 145.9%, which exceeded the action limit (AL) of 50%, an 8-hour TWA (time weighted average) sound level of 85 dBA. The employee's 8-hour TWA sound level was 92.7 dBA during the 131 minute sampling period. Zero exposure was assumed for the time not sampled.  b.)  Huck's Pallet LLC, at the jobsite located at 3810 Tick Ridge road, Vincent, Ohio 45784: On and/or preceding January 6, 2022, the employer failed to develop and implement a monitoring program for an employee exposed at or above an 8-hr time-weighted average of 85 decibels. An employee working as a laborer was exposed to continuous noise at 110.7 % on January 6, 2022, which exceeded the action limit (AL) of 50%, an 8-hour TWA (time weighted average) sound level of 85 dBA. The employee's 8-hour TWA sound level was 90.7 dBA during the 461 minute sampling period. Zero exposure was assumed for the time not sampled. Time weighted average includes a zero increment for the 19 minutes not sampled. Failure to complete annual audiometric testing prevents detection of hearing loss attributed to occupational noise exposures.

At least annually after obtaining the baseline audiogram, the employer shall obtain a new audiogram for each employee exposed at or above an 8-hour time-weighted average of 85 decibels.  a)  Huck's Pallet LLC, at the jobsite located at 3810 Tick Ridge road, Vincent, Ohio 45784: On and/or preceding January 6, 2022, the employer did not ensure that audiometric testing were provided at least annually for each employee exposed at or above an 8-hr time-weighted average of 85 decibels.  An employee working on the production line was exposed to continuous noise at 110.7 % on January 6, 2022, which exceeded the action limit (AL) of 50%, an 8-hour TWA (time weighted average) sound level of 85 dBA. 29 CFR  1910.1200(e)(1): Employers shall develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training will be met.  a)  Huck's Pallet LLC, at the jobsite located at 3810 Tick Ridge road, Vincent, Ohio 45784: On and/or preceding January 6, 2022, the employer failed to develop, implement and maintain a written hazard communication program on hazardous chemicals in the workplace such as, but not limited to, aerosols containing acetone, propane, toluene and methyl propyl ketone.  The Huck's Pallet, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1910.1200(e)(1), which was contained in OSHA inspection number 1356381, citation number 2, item number 3 and was affirmed as a final order on March 5, 2019, with respect to a workplace located at 3810 Tick Ridge road, Vincent, Ohio 45784.
