29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a.) On or about Friday, November 12, 2021 at 42-27 217th Street, Bayside, NY, 11359.  An employee installing solar panels to a residential rooftop approximately 22 feet above the lower level was not protected from falling to the lower level.    ABATEMENT CERTIFICATION IS NOT REQUIRED PURSUANT TO 29 CFR 1903.19.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  a.) On or about Friday, November 12, 2021 at 42-27 217th Street, Bayside, NY, 11359.  An employee installing solar panels on a residential rooftop was not trained on the use of fall protection.  The working level was approximately 22 feet from the lower level.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN ADDITIONAL PENALTY OF $1,000.00 AS PER 29 CFR 1903.19

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  a.) On or about Friday, November 12, 2021 at 42-27 217th Street, Bayside, NY, 11359.  An employee using a ladder to access roof to install solar panels to a residential rooftop without a ladder extending 3 feet over the upper landing surface.   ABATEMENT CERTIFICATION IS NOT REQUIRED PURSUANT TO 29 CFR 1903.19.
