29 CFR  1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace:    a) Aldi Warehouse, 300 NY 281, Tully, NY - Cold Storage Area. On or about 11/30/2021, employees including, but not limited to a foreman and carpenter were cutting concrete with a walk-behind concrete saw. The employees were provided with and required to wear N-95 respirators. The employer did not provide medical evaluations to determine the employees' ability to use respirators before they were fit-tested or required to use them in the workplace.    Abatement documentation must be submitted for this item

29 CFR  1926.1153(d)(1): The employer did not ensure that employees were not exposed to an airborne concentration of respirable crystalline silica in excess of 50 microg/m3, calculated as an 8-hour TWA:   a) Aldi Warehouse, 300 NY 281, Tully, NY - Cold Storage Area. On or about 11/30/2021, employees including, but not limited, to a carpenter was cutting concrete with a walk-behind concrete saw and overexposed to an 8 -hour time weighted average of respirable crystalline silica at 106.6 micrograms per cubic meter or 2.1 times the permissible exposure limit of 50 micrograms per cubic meter for the 341 minute sampling period. A zero increment was included for the 139 minutes not sampled.   b) Aldi Warehouse, 300 NY 281, Tully, NY - Cold Storage Area. On or about 11/30/2021, employees including, but not limited to, a foreman was cutting concrete with a walk-behind concrete saw and overexposed to an 8 -hour time weighted average of respirable crystalline silica at 59.1 micrograms per cubic meter or 1.2 times the permissible exposure limit of 50 micrograms per cubic meter for the 350 minute sampling period. A zero increment was included for the 130 minutes not sampled.

On or about 11/30/2021, employees including, but not limited to, a  carpenter and a foreman were cutting concrete with a walk-behind concrete. The employees were provided with and required to wear an N-95 respirator. The employer did not institute a respirator program in accordance  29 CFR 1910.134 to comply with the requirements in Table 1 of 29 CFR 1926.1153 when a walk-behind concrete saw is used indoors.   Abatement documentation must be submitted for this item
