29 CFR  1926.20(b)(1):It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part.  a) Chin Garcia Construction, LLC, at a jobsite located at 8617 Taylor Road, Building 3, Reynoldsburg, Ohio 43068: On and/or preceding November 17, 2021, the employer did not initiate and maintain a safety and health program such as but not limited to  a fall protection program, to ensure detection and correction of hazards during construction activities.

29 CFR  1926.501(b)(13):"Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure.   a) Chin Garcia Construction, LLC, at a jobsite located at 8617 Taylor Road, Building 3, Reynoldsburg, Ohio 43068: On and/or preceding November 17, 2021, the employer did not ensure employees were protected from falls while engaged in residential construction activities. Employees were framing the second story. The employees did not have any means of fall protection, thereby exposed to fall hazards of up to 10 feet.

29 CFR  1926.503(a)(1):The employer shall provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.  a) Chin Garcia Construction, LLC, at a jobsite located at 8617 Taylor Road, Building 3, Reynoldsburg, Ohio 43068: On and/or preceding November 17, 2021, the employer did not ensure employees were adequately trained to recognize the hazards of falling and the procedures required to be followed in order to minimize the fall hazards. Employees were framing the second story of a building and did not know when fall protection was required, thereby being exposed to a 10 foot fall hazard.
