Employees were working in an excavation that had unsupported vertical walls. These conditions exposed employees to hazards related to trench wall cave-in.   Big Al's Contracting LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.20(b)(2), which was contained in OSHA inspection number 1422106, citation number 1, item number 1a, and was affirmed as a final order on November 7, 2019, with respect to a workplace located at South Elm Street, Central Basin 2 Project, Lennox, SD 57039.     Abatement Note: OSHA defines a "competent" person as one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them.

These conditions exposed employees to cave-in hazards as a result of working in an excavation with vertical unsupported walls over five feet.  Big Al's Contracting LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.21(b)(2), which was contained in OSHA inspection number 1422106, citation number 1, item number 1b, and was affirmed as a final order on November 7, 2019, with respect to a workplace located at South Elm Street, Central Basin 2 Project, Lennox, SD 57039.

(b)Big Al's Contracting LLC at Main Street & Washington Avenue, Salem, SD 57058: On or about and at times prior to November 22, 2021, the exposing employer did not ensure that employees conducting work in an excavation were protected from cave-in hazards. Employees were installing box inlets in the southwest excavation (excavation number 1) approximately nine feet in depth which lacked an adequate protective system, such as sloping, benching, or shielding system. This condition exposed employees to cave-in hazards within an excavation greater than nine feet deep.
