29 CFR  1926.1408(a)(1): The employer failed to identify the work zone by either demarcating the boundaries and prohibiting the operator from operating the equipment past those boundaries, or defining the work zone as the area 360 degrees around the equipment and up to the equipment's maximum working radius:   (a) Near Wissota Falls hydro plant; On or before December 8, 2021, the work zone was not identified or defined before a National Crane brand, swing seat boom truck crane, model NBT-36, was used to unload barges, spud holders, and spuds for winter storage.  An employee was injured when the load line contacted an overhead transmission line on December 8, 2021 and passed away as a result of those injuries.

29 CFR 1926.1408(a)(2): The employer did not determine if any part of the equipment, load line or load (including rigging and lifting accessories), if operated up to the equipment's maximum working radius in the work zone, could get closer than 20 feet to a power line:   (a) Near Wissota Falls hydro plant; On or before December 8, 2021, no determination was made before a National Crane brand, swing seat boom truck crane, model NBT-36, was used to unload barges, spud holders, and spuds for winter storage.  An employee was injured when the load line contacted an overhead transmission line on December 8, 2021 and passed away as a result of those injuries.
