29 CFR  1910.28(b)(1)(i):29 CFR 1910.28(b)(1)(i):  Except as provided elsewhere in this section 29 CFR 1910.28, the employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the systems described in 29 CFR 1910.28(b)(1)(i):  a) Jobsite, 106 Turnberry Circle, Latrobe, PA:  On or about January 19, 2022, employees work on the roof of trailers everyday at heights of approximately 10.5 feet above the ground and are not provided with fall protection.  b) Jobsite, 106 Turnberry Circle, Latrobe, PA:  On December 29, 2021, an employee was building a shelving unit approximately 9.5 feet above the ground, was not protected from falling and suffered an injury when the platform he was working on fell and he grabbed the uprights to avoid falling to the floor.

29 CFR  1910.132(d)(1):The employer did not assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE):  a)Jobsite, 106 Turnberry Circle, Latrobe, PA:  On or about January 19, 2022, employees were performing tasks that require PPE and the employer did not perform a workplace hazard assessment to determine if hazards were present and what PPE would be needed to protect employees in situations such as, but not limited to; working on top of trailers that are 10.5 feet above the ground without fall protection.

29 CFR  1910.132(f)(1):The employer did not provide training to each employee who is required by this section to use personal protective equipment:  a) 106 Turnberry Circle, Latrobe, PA:  On or about January 19, 2022, employees were exposed to fall hazards while working on top of trailers at approximately 10.5 feet above the ground and had not been trained on how to protect themselves from the hazards by utilizing fall protection.

29 CFR  1910.178(a)(4):Modifications and additions which affect capacity and safe operation of powered industrial truck were performed by the employer without the manufacturer's prior written approval:  a) Facility, 106 Turnberry Circle, Latrobe, PA:  On or about March 9, 2022, an employee was using a Toyota forklift with an attachment to move trailers inside and outside of the building that did not have the manufacturer's written approval  to use it with their forklift.

29 CFR  1910.178(a)(5):The powered industrial truck was equipped with front-end attachments other than factory installed attachments, however the employer did not request that the truck be marked to identify the attachments and show the approximate weight of the truck and attachment combination at maximum elevation with load laterally centered:  a) Facility, 106 Turnberry Circle, Latrobe, PA:  On or about March 9, 2022, an employee was using a Toyota forklift with an attachment to move trailers inside and outside of the building that did not have a data plate to reflect the new capacity of the forklift and new specifications when used with the attachment.

29 CFR  1910.178(l)(1)(i):The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):  a) Facility, 106 Turnberry Circle, Latrobe, PA:  On or about March 9, 2022, employees were operating forklifts on a daily basis and had not been trained or certified to operate them.
