29 CFR  1910.132(d)(2):  The employer did not verify that the required workplace hazard assessment has been performed through a written certification that identifies the workplace evaluated; the person certifying that the evaluation has been performed; the date(s) of the hazard assessment; and, which identifies the document as a certification of hazard assessment:  Location: 6801 West Side Ave. North Bergen, NJ 07047 - Shipping Warehouse   a) The Temp Agency employer did not verify that a workplace hazard assessment had been conducted prior to assigning temporary employee(s) to the worksite where they would be operating forklifts and replacing propane tanks requiring the use of eye, hand and foot protection. Condition noted on or about 01/19/2022.

29 CFR  1910.178(l)(3):  Powered industrial truck operators did not receive initial training in the following topics, specified in paragraphs (l)(3)(i)(A)-(l)(3)(ii)(A) of this section:   Location: 6801 West Side Ave. North Bergen, NJ 07047 - Shipping Warehouse   a) Temp Agency employees were exposed to struck by hazards while conducting forklift operations without having a complete understanding of the operating instructions and precautions listed in the  operator's manual to include specific training on surface conditions such as ramp and other sloped surfaces that could impact vehicle stability.  On 01/15/2022 a temp employee was struck and injured by a forklift after it rolled down a ramp.  Condition noted on or about 01/19/2022.

29 CFR  1910.178(m)(5)(i):  When a powered industrial truck is left unattended, load engaging means were not fully lowered, controls were not neutralized, power was not shut off, and brakes set:  Location: 6801 West Side Ave. North Bergen, NJ 07047 - Shipping Warehouse   a) On  01/5/2022 Temp Agency employees were exposed to struck by hazards while conducting warehouse operations near loading dock ramps when an active and unattended forklift rolled in reverse and struck a temp employee in the leg.   Condition noted on or about 01/19/2022.
