29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace  (a) Painting Area:   On February 3, 2022 and times prior, an employee was required to wear a 3M half mask air purifying respirators while painting to protect from paint vapors, such as but not limit to, xylene, ethylbenzene, and n-butyl acetate.    The employer has not ensured that the employee had a medical evaluation prior to the required respirator use.  Amanda Crum dba A&A Auto Body was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.134(c)(1), which was contained in OSHA inspection number 1518253, citation number 1, item number 1a and was affirmed as a final order on June 25, 2021, with respect to a workplace located at 438 Enterprise Dr., Logan, WV 25601.

29 CFR 1910.134(f)(2):  The employer did not ensure that an employee using a tight-fitting facepiece respirator is fit tested prior to initial use of the respirator, whenever a different respirator facepiece (size, style, model or make) is used, and at least annually thereafter:  (a) Painting Area:  On February 3, 2022 and times prior, an employee was required to wear 3M half mask air purifying respirators while painting to protect from paint vapors, such as but not limit to, xylene, ethylbenzene, and n-butyl acetate.  The employer has not ensured that the employees were fit tested prior to the required respirator use and then annually thereafter.  Amanda Crum dba A&A Auto Body was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.134(f)(2), which was contained in OSHA inspection number 1518253, citation number 1, item number 1c and was affirmed as a final order on June 25, 2021, with respect to a workplace located at 438 Enterprise Dr., Logan, WV 25601.
