29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used. Cross braces were used as a means of access: On or about 2/10/2022, at the jobsite on the south and east corners of the structure, employees were observed climbing the frames of the scaffold to access and egress from the second and third platform levels, measured to be approximately 14 and 20 feet, respectively, above the ground a practice that exposed them to the hazard of falling from the scaffold to the ground.

On or about 2/10/2022, at the jobsite on the south and east corners of the structure, employees working from the scaffold system were exposed to the hazard of falling from the scaffolds in the following instances: a-g) third level, 7 unguarded platforms; h-j) second level, east side, 3 platforms--no midrails; k-l) second level, east side, 2 end frames--no guarding; m-o) second level, south side, 3 platforms--no midrails; p) second level, west end of south side--no guarding; q) second level, south side, west end crossover platform--no guarding.
