29 CFR  1915.111(a):All gear and equipment provided by the employer for rigging and materials handling shall be inspected before each shift and when necessary, at intervals during its use to ensure that it is safe. Defective gear shall be removed and repaired or replaced before further use.  a) On 3/2/2022 the employer did not properly inspect the welds that was attached on 3/1/2022 that was a load bearing pad eye to the bottom of a vessel that employees utilized in the process of replacing a wheel on the bottom of a vessel. The welds failed during the lifting process.

29 CFR  1915.116(b):Loads shall be safely rigged before being hoisted.  a) On 3/2/22 the employer did not ensure that a welded pad-eye, a Harrington 5-ton hoist (model #CF4) and a wheel (5000 lbs.) was safely rigged in that the weld that was supporting the load, failed causing the wheel to fall onto an employee.

29 CFR  1915.116(q):At no time shall an employee be permitted to place himself in a hazardous position between a swinging load and a fixed object.   a) On 3/2/22 the employer did not ensure that employees replacing the wheel of a vessel did not place themselves in the swing radius of a load, as a result an employee was struck by a wheel weighing 5000 lbs. when the weld that attached the pad-eye used to move the load failed.
