29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person. On or about February 17, 2022, and at times prior thereto, the employer did not conduct inspections while workers were installing tiles on a commercial roof at heights above 14 feet, exposing workers to hazards such as, but not limited to fall and struck-by.

29 CFR 1926.602(d): The employer did not certify that each operator had been trained and evaluated as required by paragraph 29 CFR 1910.178(l):Note: The requirements applicable to construction work under paragraph (d) of this section are identical to those set forth at paragraph (l) of 29 CFR 1910.178. 29 CFR 1910.178(l)(1)(ii): The employer did not ensure that each operator had successfully completed the training required by paragraph (l), except as permitted by paragraph (l)(5), prior to permitting an employee to operate a powered industrial truck On or about February 17, 2022, and at times prior thereto, workers were operating a JLG Rough Terrain Truck, Model G6-42A without the employer verifying training and qualifications; exposing employees to struck-by and fall hazards.
