29 CFR  1910.22(d)(2):(2) Hazardous conditions on walking-working surfaces are corrected or repaired before an employee uses the walking-working surface again.  If the correction or repair cannot be made immediately, the hazard must be guarded to prevent employees from using the walking-working surface until the hazard is corrected or repaired.  a. On and/or before March 2, 2022, the employer did not ensure that walking-working surfaces were repaired before employees used the walking-working surface. Employees were exposed to fall hazards while working in the shop area of the building where the floor grating was damaged.

29 CFR  1910.132(a):Application. Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, shall be provided, used, and maintained in a sanitary and reliable condition wherever it is necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact.  a. On and/or before March 2, 2022, the employer did not ensure employees used personal protective equipment. Employees used chemicals such as but not limited to degreasers and solvents without using all required personal protective equipment, thereby being exposed to chemical contact hazards.

29 CFR 1910.178(l)(4)(ii): Refresher training in relevant topics shall be provided to the operator when:  29 CFR  1910.178(l)(4)(ii)(B):The operator has been involved in an accident or near-miss incident.  a. On and/or before March 2, 2022, the employer did not ensure refresher training was conducted for operators who were in an accident or a near-miss incident. An employee damaged a door to the shop when the load that was being carried by a forklift struck the edge of the door and no refresher training was conducted.

29 CFR 1910.178(l)(4)(ii): Refresher training in relevant topics shall be provided to the operator when:  29 CFR  1910.178(l)(4)(iii):An evaluation of each powered industrial truck operator's performance shall be conducted at least once every three years.  a. On and/or before March 2, 2022, the employer did not ensure an evaluation of each powered industrial truck operator's performance was conducted at least once every three years. Employees who operated forklifts had not received an evaluation after three years of operating forklifts.
