29 CFR 1910.178(a)(4): Modifications and additions which affect capacity and safe operation of powered industrial trucks were performed by the employer without the manufacturer's prior written approval:   a) Warehouse - On or about November 27, 2021, the employer failed to ensure that the manufacturer's prior written approval was obtained before performing modifications which could affect capacity and safe operation of a powered industrial trucks, such as the forklift platform safety cage attachment.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records

29 CFR  1904.41(a)(2): 29 CFR 1904.41(a)(2):  The establishment had 20 or more but fewer than 250 employees at any time during the previous calendar year, and the establishment was classified as an industry listed in appendix A to subpart E of this part, but did not electronically submit information from OSHA 300A Summary of Work-Related Injuries and Illnesses to OSHA or OSHA's designee.  The employer did not submit the information once a year, no later than the date listed in paragraph (c) of this section of the year after the calendar year covered by the form:  a) On or about March 2, Nubani Distributors, Inc., did not electronically submit information from their OSHA Form 300A or equivalent to OSHA for calendar year 2021. The establishment employed 42 employees and was classified with NAICS 424450 .  In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
