OSH ACT of 1970 Section (5)(a)(1) of the Occupational Safety and Health Act: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were not protected from the hazard of being struck-by, caught-in, or caught under during product handling operations. a) At the Mixer Area, on or about 3/21/2022: The employer failed to ensure operators were competent in the use of a CM Lodestar 1 ton chain hoist to transfer dough by lifting a dough vat from the mixer to the dough hopper. b) At the Mixer Area, on or about 3/21/2022: A CM Lodestar 1 ton chain hoist was used to transfer dough by lifting a dough vat from the mixer to the dough hopper before first ensuring the hoist was inspected as required.
