29 CFR  1910.147(c)(1):The employer did not establish a program consisting of an energy control procedure, employee training and periodic inspections to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative:  a) Warehouse - On or about March 16, 2022, the employer did not ensure an energy control program consisting of an energy control procedure, employee training and periodic inspections was established for employees performing service and maintenance on machines including, but not limited to, Alligator Shear Machine  Constellation Steel Master Model 1 1/2 and Serial # E6337.  The employees were thereby exposed to hazards associated with point of operation hazards.

29 CFR  1910.212(a)(3)(ii): Point(s) of operation of machinery were not guarded to prevent employee(s) from having any part of their body in the danger zone(s) during operating cycle(s):   a) On or about March 16, 2022, in the shop area, the employer failed to provide effective guarding to protect employees working at or near the Alligator Shear Machine.  There was no guarding device for this machine and therefore nothing protected employees from operating the machine while in the zone of danger during the shearing process.  Employees were, thereby, exposed to a struck-by and amputation hazards.
