29 CFR  1910.147(c)(4)(ii): Procedures did not clearly and specifically outline the scope, purpose, authorization, rules, and techniques to be utilized for the control of hazardous energy, and the means to enforce compliance.  This includes, but not limited to the following:  A)A specific statement of the intended use of the procedure B)Specific procedural steps for shutting down, isolating, blocking and securing machines or equipment to control hazardous energy. C)Specific procedural steps for the placement, removal and transfer of lockout devices or tagout devices and the responsibility for them. D)Specific requirements for testing a machine or equipment to determine and verify the effectiveness of lockout devices, tagout devices, and other energy control measures.  (a) Shur-Co, LLC, Inc. at 1212 North Norbeck Street, Vermillion, SD 57069: On or about and at times prior to March 30, 2022, the employer did not establish a program consisting of specific energy control procedures to control hazardous energy exposure on multiple energy source pieces of equipment to include but not limited to the Stimpson Double Action Grommet Machine (serial number 48838012).   This condition exposed multiple employees to crushing, amputation shock and air embolisms while maintaining equipment.

29 CFR  1910.212(a)(3)(ii): Point(s) of operation of machinery were not guarded or guards were not designed and constructed to prevent employee(s) from having any part of their body in the danger zone(s) during operating cycle(s):  (a) Shur-Co, LLC, Inc. at 1212 North Norbeck Street, Vermillion, SD 57069: On or about and at times prior to March 30, 2022, the employer did not ensure the point of operation on the Stimpson Double Action Grommet Machine (serial number 48838012) was properly guarded to prevent employees from having any part of the their body in the danger zone during machine operations. This hazard exposed employees to crushing and amputation hazards.

29 CFR  1910.212(a)(3)(iii): Special handtools were not used for placing and removing material to permit safe handling of material without the operator placing a hand in the danger zone. Such tools shall not be in lieu of other guarding required by this section, but can only be used to supplement protection provided:  (a) Shur-Co, LLC, Inc. at 1212 North Norbeck Street, Vermillion, SD 57069: On or about and at times prior to March 30, 2022, the employer did not ensure that special tools or other means were utilized for placing and/or removing materials from the Stimpson Double Action Grommet Machine (serial number 48838012).  This condition exposed the employee to amputation hazards associated with the punch and mandrel.
