29 CFR 1910.147(c)(1): The employer did not establish a program consisting of an energy control procedure, employee training and periodic inspections to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative:  (a)	On or before April 27, 2022, the employer did not establish a program consisting of energy control procedures and employee training to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energizing, start up or release of stored energy could occur and cause injury, the machine or equipment would be isolated from the energy source, and rendered inoperative, including but not limited to Skid Steers and Skid Steers with equipment attachments. This condition exposed employees to struck-by and crushing hazards.

29 CFR 1910.147(c)(7)(i): The employer did not provide training to ensure that the purpose and function of the energy control program are understood by employees and that the knowledge and skills required for the safe application, usage, and removal of the energy controls are acquired by employees:  (a)	On or before April 27, 2022, the employer did not provide adequate training to ensure that employees acquired the knowledge and skills necessary for the safe application, usage and removal of energy control devices when performing maintenance on equipment such as, but not limited to skid steers and skid steers with equipment attachments. This condition exposed employees to struck-by and crushing hazards.

29 CFR 1904.39(a)(2): The employer did not report an in-patient hospitalization, amputation, or loss of an eye as a result of a work-related incident to OSHA within twenty-four (24) hours:  (a)	The employer did not report a work-related in-patient hospitalization incident to OSHA within 24 hours. On April 5, 2022, an employee performing maintenance on a Bobcat sweeper attachment, which was raised above him and was attached to a Caterpillar skid steer, sustained serious injuries when the sweeper detached from the skid steer lift-arm and struck him.  The employee was admitted to the hospital.
