29 CFR  1910.95(d)(1): When information indicated that any employee's exposure equaled or exceed the 8-hour time-weighted average of 85 decibels, the employer did not develop and implement a monitoring program:  (a) On or about May 4, 2022 and at times prior thereto, the employer failed to develop and implement a noise monitoring program for high noise exposure areas of the facility. Ambient noise measurements conducted by CSHO on May 4, 2022 indicated calculated TWA exposures of 91.9 dbA in the high noise areas of the worksite, exceeding both the 85 dBA OSHA Action Level and the PEL.
