29 CFR 1910.141(d)(1): Washing facilities were not maintained in a sanitary condition:  a) Saw Mill bathroom; On or about May 24, 2022 and at times prior to the employer exposed employees to sanitary hazards in that employees were required to use a bathroom that did not get cleaned and had piles of soiled toilet paper and hand towels on the floor.  The MDLG, Inc. DBA Phenix Lumber Company was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1910.141(d)(1), which was contained in OSHA inspection number 1476807, citation number 1, item number 2 and was affirmed as a final order on 11/23/21, with respect to a workplace located at 4 Cutrate Road, Phenix City, AL 36870.

29 CFR 1910.146(g)(1): The employer did not provide training so that all employees whose work was regulated by 29 CFR 1910.146  acquired the understanding, knowledge, and skills necessary for the safe performance of the duties assigned under 29 CFR 1910.146:  a) Silo; On or about May 24, 2022 and at times prior to, the employer allowed employees to work in the confined spaces of the woodchip silo without first training employees on the hazards associated with permit required confined spaces or the procedures and practices to enter confined spaces exposing employees to confined space hazards.  The MDLG, Inc. DBA Phenix Lumber Company was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1910.146(g)(1), which was contained in OSHA inspection number 1476807, citation number 1, item number 3c and was affirmed as a final order on 11/23/21, with respect to a workplace located at 4 Cutrate Road, Phenix City, AL 36870.

29 CFR 1910.147(c)(7)(i)(A): Authorized employee(s) did not receive training in the recognition of applicable hazardous energy sources, the type and magnitude of the energy available in the workplace, and the methods and means necessary for energy isolation:  a) Boiler; On or about May 24, 2022 and at times prior to, the employer allowed the Night Boiler Operator to conduct maintenance activities on the woodchip silo without providing them the training to isolate energy sources exposing the employee to caught-in hazards.  The MDLG, Inc. DBA Phenix Lumber Company was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1910.147(c)(7)(i)(A), which was contained in OSHA inspection number 1476807, citation number 2, item number 3 and was affirmed as a final order on 11/23/21, with respect to a workplace located at 4 Cutrate Road, Phenix City, AL 36870.

29 CFR  1904.41(a)(2):29 CFR 1904.41(a)(2) Annual electronic submission of OSHA Form 300A Summary of Work-Related Injuries and Illnesses by establishments with 20 or more employees but fewer than 250 employees in designated industries. If your establishment had 20 or more employees but fewer than 250 employees at any time during the previous calendar year, and your establishment is classified in an industry listed in appendix A to subpart E of this part, then you must electronically submit information from OSHA Form 300A Summary of Work-Related Injuries and Illnesses to OSHA or OSHA's designee. You must submit the information once a year, no later than the date listed in paragraph (c) of this section of the year after the calendar year covered by the form.   On or about May 24, 2022, the employer failed to electronically submit information from their OSHA Form 300A, Summary of Work-Related Injuries and Illnesses or equivalent form, for calendar year 2021 on or before March 2, 2022.  The establishment employed 47 employees during calendar year 2021 and was classified under NAICS code 321113.
