OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by and/or caught-between hazards:  On or about June 8, 2022, at the site located at Yoder Ln and Hyer Ln, Whitewater, WI 53190, the employer did not ensure that employees were working outside the swing radius and operational reach of an excavator with bucket thereby exposing employees to struck-by and/or caught-between hazards.  On June 8, 2022 an employee was working inside a trench shield while the excavator was grading stone within the same trench shield. The employee was working within the swing radius and in line with the operation of the excavator's bucket. The employee was struck-by the excavator's bucket receiving serious injuries.
