OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by and/or caught-between hazards:  On or about June 8, 2022, at the site located at Yoder Ln and Hyer Ln, Whitewater, WI 53190, the employer did not ensure that employees were working outside the swing radius and operational reach of an excavator with bucket thereby exposing employees to struck-by and/or caught-between hazards.  On June 8, 2022 an employee was working inside a trench shield while the excavator was grading stone within the same trench shield. The employee was working within the swing radius and in line with the operation of the excavator's bucket. The employee was struck-by the excavator's bucket receiving serious injuries.

29 CFR 1904.41(a)(2) Annual electronic submission of OSHA Form 300A Summary of Work-Related Injuries and Illnesses by establishments with 20 or more employees but fewer than 250 employees in designated industries. If your establishment had 20 or more employees but fewer than 250 employees at any time during the previous calendar year, and your establishment is classified in an industry listed in appendix A to subpart E of this part, then you must electronically submit information from OSHA Form 300A Summary of Work-Related Injuries and Illnesses to OSHA or OSHA's designee. You must submit the information once a year, no later than the date listed in paragraph (c) of this section of the year after the calendar year covered by the form.  On or about March 2, 2022, the employer did not electronically submit their information from their 2021 OSHA 300A Summary of Work-Related Injuries and Illnesses to OSHA or OSHA's designee.
