29 CFR  1903.19(c)(1): The employer did not certify to OSHA, within 10 calendar days after the abatement date, that the cited violation had been abated:   a) Church of the Living Word, 6099 Court Street Road, Syracuse, NY 13206, on or about 6/13/22: The employer did not provide abatement certification for Citation 1, Item 001 for a violation of  29 CFR 1926.502(d)(15)(ii) where anchorages used for attachment of personal fall arrest systems were not designed, installed and used under the supervision of a qualified person. which was issued on December 13, 2022.  An abatement demand letter was sent to the employer on May 23, 2023.     Abatement certification must be submitted for the above listed items.

29 CFR 1926.502(d)(15)(ii): 29 CFR 1926.502(d)(15)(ii): Anchorages used for attachment of personal fall arrest systems were not designed, installed and used under the supervision of a qualified person:   a) Church of the Living Word, 6099 Court Street Road, Syracuse, NY 13206, on or about 6/13/22: Following an inspection where fall hazards were addressed, the foreman and self-described competent person deployed fall protection equipment, including 5 roof anchors that were not installed according to manufacturer's instructions.  The foreman provided images that he captured for the purposes of abating the fall hazards and demonstrating the flawed installation.  Abatement certification must be submitted for this item.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):  a) Church of the Living Word, 6099 Court Street Road, Syracuse, NY 13206, on or about 6/13/22: Workers were stripping and installing new roofing material to 30,000 square feet of roof, with a 4:12 pitch and a lower level to eave height of 10 feet and ground to eave heights of 12 feet, without fall protection of any kind.  5 Star Construction Corp was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1584246, citation number 1, item number 1 and was affirmed as a final order on 6/22/22, with respect to a workplace located at 2105 Valley Drive, Syracuse, NY  13207.
