29 CFR  1903.19(d)(1): The employer did not submit to the Agency documents demonstrating that abatement is complete for each willful or repeat violation and for any serious violation for which the Agency indicates in the citation that such abatement documentation is required.  a) On or about August 14, 2024, at the worksite, 103 Pitcher Lane, North Syracuse, NY 13212: The employer failed to provide abatement certification for citation 1 -1 identified in the inspection of this workplace. An abatement demand letter was sent to the employer on March 10, 2025.  5 Star Construction Corp. was previously cited for a violation of this occupational safety and health standard or its equivalent standard (1903.19(d)(1)), which was contained in OSHA inspection number 1744355, citation number 3, item number 1 and was affirmed as a final order on March 10, 2025, with respect to a workplace located at 4605 E Genesee Street, Syracuse NY.

29 CFR  1926.503(a)(1): The employer did not provide a training program for each employee exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  a)  On or about August 14, 2024, at the worksite, 103 Pitcher Lane, North Syracuse, NY 13212: When employees engaged in residential roofing activities were exposed to fall hazards, the employer failed to ensure the employees were trained in the recognition of fall hazards and the procedures to be followed to minimize the hazards.

29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system:  a)  On or about August 14, 2024, at the worksite, 103 Pitcher Lane, North Syracuse, NY 13212: when employees were replacing a 5:12 pitch roof, the employer failed to ensure the employees were protected from fall hazards by use of guardrail systems, safety net systems, or personal fall arrest systems.  The employees were exposed to fall hazards of 9 feet.  Segundo Caguana DBA 5 Star Construction 1 Corp. 5 Star Construction Corp. was previously cited for a violation of this occupational safety and health standard 1926.501(b)(13), which was contained in OSHA inspection number 1552410, citation number 1, item number 1, and was affirmed as a final order on November 7, 2021, with respect to a workplace located at 4554 Ashfield Terrace, Syracuse, NY 13215.  Segundo Caguana DBA 5 Star Construction 1 Corp. 5 Star Construction Corp. was previously cited for a violation of this occupational safety and health standard 1926.501(b)(13), which was contained in OSHA inspection number 1584246, citation number 1, item number 1and was affirmed as a final order on June 22, 2022, with respect to a workplace located at 2105 Valley Drive, Syracuse, NY 13207.  Segundo Caguana DBA 5 Star Construction 1 Corp. 5 Star Construction Corp. was previously cited for a violation of this occupational safety and health standard 1926.501(b)(13), which was contained in OSHA inspection number 1602077, citation number 2, item number 1 and was affirmed as a final order on April 11, 2023, with respect to a workplace located at 6099 Court Street Rd, Syracuse, NY 13206.
