29 CFR 1926.1053(b)(1): Where portable ladders were used for access to upper landing surfaces, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladders were used to gain access. a) 43-48 Hearthstone Court, Upper Saddle River NJ: Employee using a portable extension ladder was exposed to fall hazards of approximately 30 feet as the ladder side rails did not extend 3ft above the upper landing surface. 1926.1053 states that "when such an extension ladder is not possible because of the ladder's length, then the ladder shall be secured at its top to a rigid support that will not deflect, and a grasping device, such as a subrail shall be provided to assist employees in mounting and dismounting the ladder." Condition observed on or about 07/09/2022. Pursuant to 29 CFR 1926.19, within 30 days, the employer must submit documents describing the steps it is taking to ensure compliance, including a description of the type of head protection provided and the steps taken to enforce use of appropriate head protection where employees are exposed to possible danger of head injuries.

Guilsen Lima dba Extreme Roofing and Siding LLC does not ensure that employees use appropriate head protection while engaged in residential construction activities. This violation was most recently observed, on or about 07/06/2022, at 43-48 Hearthstone Court, Upper Saddle River, NJ/Roof, where employees #1, #2 #3 and #4 were exposed to overhead impact hazards, while engaged in the staging of roofing materials on a 6 on 12 pitch roof. The roofing materials were boomed overhead and placed on the roof using an articulating knuckle boom crane with a fork attachment. The employees were not provided with any protective helmet or any other appropriate head protection or head protective device. Pursuant to 29 CFR 1903.19, within 30 days, the employer must submit documents describing the steps it is taking to ensure compliance, including a description of the type of head protection provided and the steps taken to enforce use of appropriate head protection where employees are exposed to possible danger of head injuries.
