29 CFR  1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:  a) On or about July 20, 2022; Front area of the residential project (Eastside); employees working under the scaffold system were not wearing hard hats to protect them from falling objects including, but not limited to, trowels, knives and materials used by employees 18-feet overhead.   In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet), in addition, documentation demonstrating the abatement is complete must be included with your certification.  This documentation may include, but is not limited to evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR  1926.451(b)(1): Each platform on all working levels of scaffolds was not fully planked or decked between the front uprights and the guardrail supports as specified in paragraphs 1926.451(b)(1)(i)-(ii):  a) On or about July 20, 2022; Front area of the residential project (Eastside); the working platform of the scaffold system was not fully planked where up to 3 scaffold planks were missing exposing the employees to an 18-foot fall to ground level while prepping the exterior wall for stucco.   In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet), in addition, documentation demonstrating the abatement is complete must be included with your certification.  This documentation may include, but is not limited to evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR  1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used. Crossbraces were used as a means of access.  a) On or about July 20, 2022; Front area of the residential project (Eastside); the employees were accessing the work platform 18-feet above the ground level by climbing the cross braces and frame of the scaffold system.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet), in addition, documentation demonstrating the abatement is complete must be included with your certification. 29 CFR  1926.451(f)(7): Scaffolds were not erected, moved, dismantled, or altered, by trained and experienced employees under the supervision and direction of a competent person qualified in scaffold erection, moving, dismantling or alteration:; Such activities were not performed only by experienced and trained employees selected for such work by the competent person.  a) On or about July 20, 2022; Front area of the residential project (Eastside), the employer had not ensured that a competent person evaluated the scaffold system who understood the potential hazards including, but not limited to, fall hazards, and proper construction of the working platform, which exposed the employees to an estimated 18-foot fall hazard.
