29 CFR  1926.20(b)(1):The employer did not initiate and maintain accident prevention programs as necessary to comply with this part:  a)	MDS Construction LLC. On or about July 27, 2022, at the address of 1430 Westminster Rd. Bowling Green OH 43402: The employer did not have a plan or program to identify job site hazards which assists employees in maintaining a safe working environment. Such programs would support the employer and employees in identifying and avoiding potential hazards such as falls during job site operations, decreasing the probability of employee injury and/or illness. Employee working in these conditions were exposed to falls of up to 12 feet or greater.

29 CFR  1926.503(a)(1):The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  a)	MDS Construction LLC. On or about July 27, 2022, at the address of 1430 Westminster Rd. Bowling Green OH 43402: The employer did not ensure that employees had been trained in the appropriate use of fall protection such as but not limited to the use of personal fall arrest systems or alternative measures while performing framing operations from elevated surfaces greater than six feet from the level below. Employees working in these conditions were exposed to falls of up to 12 feet or greater.

Bowling Green OH 43402: The employer did not ensure each affected employee used appropriate eye or face protection while utilizing pneumatic nail guns during framing work on a residential structure. Employees working in this condition were exposed to potential struck by hazards (flying projectile/ricochet nails).

On or about July 27, 2022, at the address of 1430 Westminster Rd. Bowling Green OH 43402: The employer did not ensure employees were protected from falls while performing framing work activities atop a single-story residential structure. Employees operating in this conditions were exposed to falls of 12 feet or greater to the ground below.
