29 CFR 1910.22(d)(1): The employer did not ensure that walking-working surfaces are inspected, regularly and as necessary, and maintained in a safe condition: a) Jobsite, 363 Station Road, Scenery Hill, PA 15360: Observed on or about August 8, 2022, a large pothole was observed in the shop floor in the areas in front of furnaces 2 and 3. The pothole created a trip hazard to employees working in the area. The pothole also created hazards to employees operating forklifts in the area. b) Jobsite, 363 Station Road, Scenery Hill, PA 15360: Observed on or about August 8, 2022, a large pothole was observed on the floor of the ramp floor located near the exhaust fan and emergency eyewash station. The pothole crated a trip hazard to employees working in the area. The pothole also created hazards to employees operating forklifts in the area. c) Jobsite, 363 Station Road, Scenery Hill, PA 15360: Observed on or about December 8, 2022, a pothole was observed on the floor near right side of the scale on the lower level. The pothole created a trip hazard to employees working in the area. The pothole also created hazards to employees operating forklifts in the area. d) Jobsite, 363 Station Road, Scenery Hill, PA 15360: Observed on or about December 8, 2022, a pothole was observed on the floor of the entrance way to the lower level scale area from an adjacent room near the bottom of the ramp. The pothole created a trip hazard to employees working in the area. The pothole created hazards to employees operating forklifts in the area.

29 CFR 1910.212(a)(5): Fan blade guards, where the periphery of the blades was less than seven feet above the floor or working level, had openings larger than one half inch: a) Jobsite, 363 Station Road, Scenery Hill, PA 15360: Observed on or about August 8, 2022, an exhaust fan located on the ramp between the upper and lower levels was not properly guarded. The gap between the shutter openings was approximately 3 inches on the side facing the ramp. An electrical disconnect switch and an emergency shower were located in close proximity to the exhaust fan.

An employee working at a desk located between a wall and the scale was injured after being pinned to the desk when the load fell off the forks.

29 CFR 1910.178(a)(4): Modifications and additions which affect capacity and safe operation of powered industrial trucks were performed by the employer without the manufacturer's prior written approval. Capacity, operation, and maintenance instruction plates, tags, or decals were not changed accordingly: a) Jobsite, 363 Station Road, Scenery Hill, PA 15360: On or about September 4, 2022, a Hyster 80 (Model H80FT, Serial Number U005V021112N) forklift was used to move a box of tin weighing approximately 8300 pounds onto a scale in the production area. The forklift data plate listed the lift capacity as 7650 pounds (at a load height of 173.8 inches) when using 60-inch forks. The employer installed 84-inch forks on the forklift but did not ensure that the forklift data plate was changed to reflect the reduced lift capacity. The lift capacity was reduced by 300 pounds to 7350 pounds.

The lifting capacity of the forklift was 7350 pounds at a lift height of 178.3 inches. The weight of the box of tin exceed to lifting capacity of the forklift capacity by approximately 950 pounds.

29 CFR 1910.305(g)(1)(iv)(A): Flexible cords and/or cables were used as a substitute for the fixed wiring of a structure: a) Jobsite, 363 Station Road, Scenery Hill, PA 15360: Observed on or about August 8, 2022, a flexible cable leading from a Square D brand heavy duty safety switch mounted on the wall to the left of the exhaust fan was used as a substitute for the fixed wiring of the structure. The cable was fastened to the top left frame of the exhaust fan, draped over a water pipe for the emergency shower, and ran around a beam of the building to the right of the exhaust fan.
