29 CFR  1910.23(b)(9): The employer did not ensure that ladders are inspected before initial use in each work shift, and more frequently as necessary, to identify any visible defects that could cause employee injury.  (a) On August 16, 2022, the employer did not ensure that ladders were inspected before initial use on each work shift, and more frequently as necessary, to identify any visible defects.  An 8-foot A-frame ladder was used on August 16, 2022 to retrieve fittings from an elevated storage racks. There were visible defects on the ladder including 1 bent rung, 1 missing rear horizontal support,  4 bent rear horizontal supports, and 2 bent spreaders.

29 CFR  1910.23(b)(10): The employer did not ensure that any ladder with structural or other defects as immediately tagged "Dangerous: Do Not Use" or with similar language in accordance with � 1910.145 and removed from service until repaired in accordance with � 1910.22(d), or replaced.  (a) On August 16, 2022, the employer did not tag and remove from service an 8-foot A-frame ladder located in the fittings aisle, on the east end of the racking area. The ladder had structural defects including one bent rung, 1 missing rear horizontal support, 4 bent rear horizontal supports, and 2 bent spreaders.
