OSH ACT of 1970 Section (5)(a)(1):Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to;  On or about August 8, 2022, at the job site located at 101 N. Main, Walton, KS: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to chemical hazards. The employer stores and uses chemicals including but not limited to Aluminum Phosphide tablets (PH3), Tempo Insecticide, and 2, 4-d Herbicide  which are eye irritants and toxic in contact with skin without facilities for quick drenching or flushing of the eyes and body within the work area for immediate emergency as required by each chemicals' safety data sheets.    Among other feasible and acceptable means of abatement: To abate these hazards comply with the American National Standards Institute (ANSI) Standard Z358.1- 2014 Emergency Eyewash and Shower Equipment, as follows: a) Install eyewash facilities that shall be capable of delivering flushing fluid to the eyes not less than 1.5 liters per minute (0.4 gpm) for 15 minutes and will comply with the American National Standards Institute, ANSI Standard Z358.1-2014 - Eyewash Equipment, Section(s) 5.
