29 CFR 1910.178(l)(1)(i):The employer shall ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l). (a)Training shall consist of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace. (a) On or about 09/08/2022, the employer did not ensure operators prior to operating the Toyota 2019 8FGCU25 SN 99937 were trained with a combination of formal instruction, practical training, and evaluation of the performance in the workplace.

29 CFR 1910.178(l)(1)(ii): Prior to permitting an employee to operate a powered industrial truck (except for training purposes), the employer shall ensure that each operator has successfully completed the training required by this paragraph (l), except as permitted by paragraph (l)(5). (a) On or about 09/08/2022, the employer did not ensure that powered industrial truck operators for the Toyota 8FGCU25 2019 forklift had successfully completed the training required by paragraph (l) of this section prior to operating the forklift.
