29 CFR  1926.21(b)(2):The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:  On or about September 15, 2022, the employer did not instruct each employee in the recognition of unsafe conditions such as operating a front-end loader without a fastened seat belt.

29 CFR  1926.28(a): The employer is responsible for requiring the wearing of appropriate personal protective equipment in all operations where there is an exposure to hazardous conditions or where this part indicates the need for using such equipment to reduce the hazards to the employees  On or about September 15, 2022,  the employer did not ensure that an operator of a front-end loader fastened the available seat belt during operation. This condition exposed the employee to a struck-by hazard.
