29 CFR  1926.453(b)(2)(v):A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift Note:  As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system:  a) Jobsite, 990 Castle Shannon Boulevard, Castle Shannon, PA:  On or about September 29, 2022, an employee was coating the gutters from an Nifty TD42T aerial lift and was not utilizing fall protection.  The fall distance was approximately 30-40 feet to the ground below.

29 CFR  1926.451(f)(7): Scaffolds were not erected, moved, dismantled, or altered, by trained and experienced employees under the supervision and direction of a competent person qualified in scaffold erection, moving, dismantling or alteration:; Such activities were not performed only by experienced and trained employees selected for such work by the competent person:  a)  Jobsite, 990 Castle Shannon Boulevard, Castle Shannon, PA:  On or about September 28, 2022, an employee was working out of Nifty TD42T aerial lift without fall protection.  The employer provided fall protection training records for the employee but did not ensure that the employees understood and retained the knowledge to utilize fall protection when it is required.
