29 CFR  1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):    (a) On October 4, 2022, at or near Lot 22 Whispering Ridge in Bismarck, North Dakota,  employees engaged in roof sheathing operations were exposed to fall hazards of  25 feet or greater.  Note: This company was previously cited for a violation of this Occupational Safety and Health standard  which was contained in OSHA Inspection Number 1592324, Citation 1, Item 1, and was affirmed as a final order on June 23, 2022, with respect to a workplace located at 4124/4126 Silver Boulevard in Bismarck, North Dakota.  Note: This company was previously cited for a violation of this Occupational Safety and Health standard  which was contained in OSHA Inspection Number 1605507, Citation 2, Item 1, and was affirmed as a final order on August 8, 2022, with respect to a workplace located at 4404 Elk Ridge Drive in Bismarck, North Dakota.

29 CFR  1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access:   a) On October 4, 2022 at the construction site located at Lot 22 Whispering Ridge in Bismarck, ND employees were exposed to fall hazards of 10 feet when Little Giant ladders used by employees to ascend or descent from an elevated walking working surface did not have rails that extended three feet above the upper landing surface.  Note: This company was previously cited for a violation of this Occupational Safety and Health standard  which was contained in OSHA Inspection Number 1592324, Citation 2, Item 1, and was affirmed as a final order on June 23, 2022, with respect to a workplace located at 4124/4126 Silver Boulevard in Bismarck, North Dakota.
