29 CFR  1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation:  a) On or about October 26, 2022, at a residential construction site located at 5639 Niagara Drive, Bismarck, ND, employees working in close proximity to someone operating pneumatic nail guns were exposed to eye and face hazards from flying particles while working on a residential roof without wearing impact resistant eye or face protection.

29 CFR  1926.1053(b)(6): Ladders shall be used only on stable and level surfaces unless secured to prevent accidental displacement:  a) On October 26, 2022, at a residential construction site located at 5639 Niagara Drive Bismarck, ND, while engaged in roofing operations, employees were allowed to continually ascend and descend a ladder that was not on a stable and level surface, and was not secured to prevent accidental displacement.

29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system:  a) On or about October 26, 2022, at a residential construction site located at 5639 Niagara Drive Bismarck, ND, while engaged in roofing activities, employees were exposed to fall hazards greater than 6 feet without a fall protection system in place.  Note: This company was previously cited for a violation of this Occupational Safety and Health standard  which was contained in OSHA Inspection Number 1592324, Citation 1, Item 1, and was affirmed as a final order on June 23, 2022, with respect to a workplace located at 4124/4126 Silver Boulevard in Bismarck, North Dakota.
