29 CFR  1926.20(b)(2):The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them:  (a)Reyes Roofing, LLC at 4201 South Oxbow Avenue, Sioux Falls, SD 57106: On or about and at times prior to October 20, 2022, the exposing employer did not ensure an accident prevention program was developed and implemented for the work environment to include regular inspections of the job-site, materials, and equipment; conducted by a competent person. Employees were conducting roofing operations on a commercial property without the use of a fall protection system on site.  This condition exposed employees to fall hazards of greater than six feet.

29 CFR 1926.501(b)(10):  Employees engaged in roofing activities on high-slope roofs with unprotected sides and edges 6 feet or more above lower levels, were not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail systems, warning line system and safety net system, warning line system and personal fall arrest system, or warning line system and safety monitoring system:  (a)Reyes Roofing, LLC at 4201 South Oxbow Avenue, Sioux Falls, SD 57106: On or about and at times prior to October 20, 2022,  the exposing employer did not ensure that employees were protected from falls while conducting roofing operations on a commercial roof. This condition exposed the employees to fall hazards greater than six feet.  Reyes Roofing, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard which was contained in OSHA inspection number 1593338, citation number 1, item number 1, and was affirmed as a final order on November 14, 2022, with respect to a workplace located at 8126 East Norway Pine Trail, Sioux Falls, SD 57110.  Reyes Roofing, LLC, was previously cited for a violation of this occupational safety and health standard or its equivalent standard which was contained in OSHA inspection number 1396551, citation number 1, item number 1a, and was affirmed as a final order on September 6, 2019, with respect to a workplace located at 8804 West 18th Street, Sioux Falls, SD 57106.
