29 CFR  1910.147(c)(4)(i): Procedures were not developed, documented and utilized for the control of potentially hazardous energy when employees were engaged in activities covered by this section:  a) Facility: On or about 10/3/2022, the employer did not develop and document procedures for the control of potentially hazardous energy for employees including, but not limited to HVAC Maintenance, who conduct HVAC maintenance and repair, belt changes, and filter changes.  An employee performing HVAC maintenance experienced UV burns to the eyes when the system was not locked out.   NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR  1910.147(c)(7)(i)(A): Authorized employee(s) did not receive training in the recognition of applicable hazardous energy sources, the type and magnitude of the energy available in the workplace, and the methods and means necessary for energy isolation:   a) Facility: On or about 10/3/2022, employees, including but not limited to HVAC Maintenance personnel, were not provided Authorized Employee Lock Out/Tag Out training to perform maintenance tasks including, but not limited to, HVAC maintenance and repair, belt changes, and filter changes. An employee performing HVAC maintenance experienced UV burns to the eyes when the system was not locked out.   NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. 29 CFR  1904.29(b)(3):Each recordable injury or illness was not entered on the OSHA 300 Log and/or an incident report (OSHA Form 301 or equivalent) within seven (7) calendar days  of receiving information that a recordable injury or illness has occurred:  a) Facility: An employee injury was  sustained on 10/3/2022 from the employee getting an UV burns to the eye after being exposed to UV light in the air handler and resulting in 13 days away from work. This injury was not recorded within seven days on the OSHA 300 log or equivalent form.  b) Facility: An employee injury was sustained on 10/3/2022 from an employee experiencing a contusion ad lacerations of the knees in the employee parking lot and resulting in 13 days of transfer or restriction. This injury was not recorded within seven days on the OSHA 300 log or equivalent form.   c) Facility:  An employee injury was sustained on 11/9/2022 from an employee experiencing a contusion of the right shoulder behind the carpenter shop and resulting in 58 days away from work. This injury was not recorded within seven days on the OSHA 300 log or equivalent form.   d) Facility: An employee injury was sustained on 11/13/2022 from an employee getting a nasal bone fracture in Pit 6 and resulting in 3 days away from work. The injury was not recorded within seven days on the OSHA 300 log or equivalent form.
