29 CFR  1910.67(b)(1): Unless otherwise provided in this section, aerial devices (aerial lifts) acquired on or after July 1, 1975, shall be designed and constructed in conformance with the applicable requirements of the American National Standard for "Vehicle Mounted Elevating and Rotating Work Platforms," ANSI A92.2 - 1969, including appendix, which is incorporated by reference as specified in 1910.6. Aerial lifts acquired for use before July 1, 1975 which do not meet the requirements of ANSI A92.2 - 1969, may not be used after July 1, 1976, unless they shall have been modified so as to conform with the applicable design and construction requirements of ANSI A92.2 - 1969. Aerial devices include the following types of vehicle-mounted aerial devices used to elevate personnel to jobsites above ground.  a) Floating Dry Dock #4, Terex Genie Model: S45   - On or about  November 7,  2022 and at times prior thereto, employees were exposed to falling from the man basket of the aerial work platform with a platform that was in disrepair and indicated severe structural damage.

29 CFR  1915.12(d)(1): The employer did not ensure that each employee that enters a confined or enclosed space and other areas with dangerous atmospheres is trained to perform all required duties safely.  a) Shaver Tug (Columbia Class) - On or about September 19, 2022 and at times prior thereto, an employee was exposed to a potential oxygen enriched/deficient, flammable, or toxic atmosphere in that they were not trained to review and understand the information contained on the Shipyard Competent Person (SCP) testing log.   Diversified Marine Inc. (DMI) was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1915.12(d)(1), which was contained in OSHA inspection number 1406052, citation number 1 , item number 1, and was affirmed as a final order on 2/18/2020, with respect to a workplace located at 1801 N. Marine Dr. Portland, OR. 97217.

29 CFR  1915.55(e)(1): Fuel gas and oxygen manifolds failed to bear the name of the substance they contain in letters at least one (1) inch high which shall be either painted on the manifold or on a sign permanently attached to it.  a) Maintenance Shop/Barge - On or about November 7, 2022 and at times prior thereto, employees were exposed to potential fire hazards without proper labeling of the oxygen manifold. Inadequate labeling of an oxygen manifold will prevent emergent identification of the valve and its associated shutoff.
