29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: (a) On or about November 7, 2022, and at times prior, paint department employees wore half-face tight fitting air purifying respirators without first being medically evaluated to ensure that they were physically fit to wear the respirator. (b) On or about November 7, 2022, and at times prior, a paint department employee wore a SATA Air vision 5000 respirator, without first being medically evaluated to ensure that they were physically fit to wear the respirator.

29 CFR 1910.134(f)(2): The employer shall ensure that an employee using a tight-fitting facepiece respirator is fit tested prior to initial use of the respirator, whenever a different respirator facepiece (size, style, model or make) is used, and at least annually thereafter: (a) On or about November 7, 2022, and at times prior, employees were exposed to respiratory hazards when engaging in prepping, painting and finish operations while using half-face tight fitting respirators without first being fit tested.
