The employer did not ensure that each operator is trained, certified/ licensed, and evaluated in accordance with this section before operating any equipment covered under subpart CC, except for the equipment listed in paragraph (a)(2) of this section.   On November 25, 2022, Wharf 4, Port of Guam: The  crane operator performing demolition work was not certified/licensed to operate the YD-120 barge crane.  Employees were exposed to struck-by and crushed-by hazards.

On November 25, 2022, at Wharf 4, Gantry Crane #2: The YD-120 barge crane was operated in excess of its rated capacity of 11,200 pounds for the whipline, when it was used to lift an A-frame leg of the boom assembly with attached caged ladder that weighed 27,000 pounds.  Employees were exposed to struck-by and crushed-by hazards.

29 CFR  1926.1417(o)(3)(i): The weight of the load was not determined from a source recognized by the industry (such as the load's manufacturer), or by a calculation method recognized by the industry (such as calculating a steel beam from measured dimensions and a known per foot weight), or by other equally reliable means.     On November 25, 2022, at Wharf 4, Gantry Crane #2: The YD-120 crane was used to lift an A-frame leg of the boom assembly with attached caged ladder without calculating the weight by a recognized industry source or other equally reliable means.  Employees were exposed to struck-by and crushed-by hazards.
