29 CFR  1910.134(a)(1): When effective engineering controls were not feasible or while they were being instituted, appropriate respirators were not used pursuant to the requirements of 29 CFR 1910.134:  In the facility at 74 Walnut Street, Springfield, MA: On November 28, 2022 and ongoing, surgical and KN95 masks were used while assisting with activities of daily living and testing of COVID-19 positive residents.  Appropriate respiratory protection while caring for suspected or confirmed COVID-19 positive residents is an N95 filtering facepiece respirator, worn in accordance with OSHA's Respiratory Protection Standard, 29 CFR 1910.134.

29 CFR  1910.134(c)(1): In any workplace where respirators are necessary to protect employee health or whenever respirators are required by the employer, a written respiratory protection program with worksite specific procedures was not established and implemented:  In the facility at 74 Walnut Street, Springfield, MA, on November 28, 2022, and ongoing, employees wore N95 filtering facepiece respirators to protect from exposure to SARS-CoV-2 virus, without an established and implemented written respiratory protection program.  Employees assisted with activities of daily living and performed testing of COVID-19 positive residents.  ABATEMENT NOTE:  A respirator program shall include the following elements:     -Procedures for selecting respirators  -Medical evaluations for employees required to use respirators  -Procedures for fit testing tight fitting respirators  -Procedures for proper use of respirators  -Procedures and schedules for cleaning, storing, inspecting, and maintaining respirators  -Training of employees about respiratory hazards in the work place  -Training on proper use of respirators  -Procedures for regularly evaluating the effectiveness of the program  *Abatement notes are intended only to provide clarity regarding existing requirements under the law or agency policies. Abatement notes do not create (or diminish) legal obligations under the Occupational Safety and Health Act.

29 CFR  1910.132(d)(2): The employer did not verify, through a written certification, that the required workplace hazard assessment had been performed:   In the facility at 74 Walnut Street, Springfield, MA:  On November 28, 2022, and ongoing, the employer had not verified, through a written certification, that an assessment to determine if hazards, such as SARS-CoV-2 the virus that causes COVID-19, were present that necessitated the use of PPE to protect employees engaged in activities of daily living and testing of COVID-19 positive residents.
