Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees from hazards associated with struck by hazards:  a) Body shop, On or about January 17, 2023, employees were exposed to struck by hazards due to rack system not having weight ratings placarded. The rack was loaded with pallets and other spot loaded materials.   b) Body shop, On or about January 17, 2023,  employees were exposed to struck by hazards due to the rack system not being anchored. The rack was loaded with pallets and other spot loaded materials.   c) The warehouse, On or about January 17, 2023, employees were exposed to struck by hazards due to the rack system not having weight ratings placarded. The racks were being used to store pallets of tire rims and bus seats.   d) The warehouse, On or about January 17, 2023,  employees were exposed to struck by hazards due to the rack system not being anchored. The racks were being used to store pallets of tire rims and bus seats.   e) The warehouse, On or about January 17, 2023,  employees were exposed to struck by hazards due to the rack system had damaged upright stanchions. The racks were being used to store pallets of tire rims and bus seats.   f) The warehouse, On or about January 17, 2023,  employees were exposed to struck by hazards due to the rack system cross members were not locked and able to withstand 1000lbs of upward pressure. The employer had paint spray operations and grinding that would require the issuance and implementation of eye and face protection, additionally the employer had a scaffolding unit that required the use of fall protection. 29 CFR 1910.307(c): Equipment, wiring methods, and installations of equipment in hazardous (classified) locations were not intrinsically safe, approved for the hazardous (classified) location, or safe for the hazardous (classified) location:  a. The paint booth - On or about January 17, 2023, the employer had installed an unrated general purpose light fixture inside the paint booth by drilling holes through the paint booth compromising the electrical classification of the booth in addition to introducing an ignition source inside the booth where paint spray operations occur.  Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

Recordkeeping - On or about January 18, 2023, the 2020 OSHA form 300 was not reviewed to determine completeness and accuracy as the form used was outdated and did not include columns K-M, additionally column F did not include the cause of the injury for entries and column E lacked specificity as to where the injuries occurred.   b. Recordkeeping - On or about January 18, 2023, the 2021 OSHA form 300 was not reviewed to determine completeness and accuracy as the form used was outdated and did not include columns K-M, column F did not include the cause of the injury for entries and column E lacked specificity as to where the injuries occurred. Injury 2 was also classified as both days away under column H and other recordable under column J and no total days for the lost time could be recorded due to the form not including column K.  c. Recordkeeping - On or about January 18, 2023, the 2022 OSHA form 300 was not reviewed to determine accuracy as column F did not include the cause of the injury for entries and column E lacked specificity as to where the injuries occurred. The employer over recorded 3 injuries that did not meet the recordkeeping requirements, and for injuries 5 and 7 which were job restriction or transfer cases classified them as other recordable cases in column J.
