29 CFR 1915.35(a)(2):Employees were not protected by filter respirators in accordance with the requirements of 29 CFR 1915 Subpart I where brush application of paints with toxic solvents was done in confined spaces, or other areas which lacked adequate ventilation; USS Kennedy at Newport News Shipbuilding: On 1/18/23, and times prior thereto, employees were exposed to paint vapors from formula 124 soft white enamel, without being provided the appropriate respirator cartridges. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1915.36(a)(2): Frequent tests were not made by a competent person to ascertain that the concentration of flammable vapors was below 10 percent of the lower explosive limit; USS Kennedy at Newport News Shipbuilding: On 1/18/23, and times prior thereto, employees were exposed uncontrolled concentrations of flammable vapors from formula 150 Green epoxy and formula 124 soft white enamel, due to the employer failing to test the effectiveness of the ventilation in enclosed spaces. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
