29 CFR 1910.178(p)(1): If at any time a powered industrial truck is found to be in need of repair, defective, or in any way unsafe, the truck shall be taken out of service until it has been restored to safe operating condition. a. On or about January 24, 2023, and at times prior, employees were operating a Crown TSP 7500 Turret Truck, T-5, that had a defective door position sensor allowing the lift to operate at elevations with the door open, thereby exposing employees to a fall hazard.

29 CFR 1910.178(q)(7): Industrial trucks shall be examined before being placed in service and shall not be placed in service if the examination shows any condition adversely affecting the safety of the vehicle. Such examination shall be made at least daily. Where industrial trucks are used on a round-the-clock basis, they shall be examined after each shift. Defects when found shall be immediately reported and corrected. a. On or about January 24, 2023, and at times prior, the employer did not ensure that forklifts in use at the facility were being inspected prior to use. On January 24, 2023, a Crown TSP 7000 Turret Truck, T-5, in operation with a defective door position sensor was not identified prior to use.
