29 CFR 1960.30(c):  The Agency official did not promptly prepare an abatement plan with the appropriate participation of the Safety and Health Official or a designee, to abate an unsafe or unhealthful working condition within 30 calendar days:  (a)Location: 3907 Polk Rd, Fort Campbell, KY.  On or about January 25th, 2023 and at times prior, the agency official, after becoming fully aware of the hazards associated with deficiencies of the ARC Flash PPE of employees, failed to prepare an appropriate abatement plan,  or follow recommendations from the Safety and Health Officials from the Installation Safety Office, to abate the unsafe working conditions within 30 days.

29 CFR  1960.9: Employer neglected its supervisory authority by not providing employees a place of employment that was free of recognized hazards that were causing or likely to cause serious physical harm or death. Employer also failed to comply with the occupational safety and health standards applicable to their agency and with all rules, regulations, and orders issued by the head of the agency with respect to the agency occupational safety and health program.  (a) Location: 3907 Polk Rd, Fort Campbell, KY.  Specific locations include buildings 7911, 7979, and several buildings in the 7200 block of the 160ths SOAR section of Fort Campbell.  On or about January 25th, 2023, and at times prior, the employer exposed employees to falls from 12 feet to 40 feet in that they allowed employees to perform work on buildings known not to have anchor points, rails, or other fall protection systems even after those buildings were identified by employees, supervisors, and by the Installation Safety Office as being unsafe for such operations.  (b) Location: 3907 Polk Rd, Fort Campbell, KY.  On or about January 25th, 2023, and at times prior, the employer exposed employees to electrocution and burn hazards in that they allowed employees to perform work on energized equipment without the proper PPE after it was identified that the PPE currently issues was no longer serviceable or had not been inspected/tested within the last 6 months.  Hazard was brought to the attention of the director and staff by employees in a town hall format, mid level supervisors, through an Army Material Command Inspection, and the Installation Safety Office.

29 CFR  1960.31(b):The Secretary's inspectors or evaluators are authorized: to enter without delay, and at reasonable times, any building, installation, facility, construction site, or other area, workplace, or environment where work is performed by employees of the agency; to inspect and investigate during regular working hours and at other reasonable times, and within reasonable limits and in a reasonable manner, any such place of employment, and all pertinent conditions, structures, machines, apparatus, devices, equipment, and materials therein, and to question privately any employee, any supervisory employee, and/or any official in charge of an establishment.  (a) 3907 Polk Rd, Fort Campbell, KY.  The Director of the Fort Campbell DPW did not, within reasonable time, in a reasonable manner, in a reasonable place, during regular working hours, make herself available to OSHA investigators for an interview despite five separate attempts over a 5 month period.
