29 CFR  1926.1400(f): The employer did not establish, effectively communicate to the relevant persons, and enforce, work rules to ensure compliance with those provisions of the Standard that direct an operator, crewmember, or other employee to take certain actions:    a) On or about 2/2/2023, at the site located at 3991 Rose Rd in Batavia, NY;  the employer did not establish a policy and procedure to ensure that all relevant safety precautions were understood and adhered to when conducting assembly and disassembly operations. Employees were exposed to struck by and crushed hazards when the crane rotated, and an employee was out of view of the crane operator.    ABATEMENT DOCUMENTATION REQUIRED

29 CFR  1926.1404(d)(1)(iii): Before commencing assembly/disassembly operations, the A/D director did not ensure that the crew members understood all of the hazardous positions/locations to be avoided:  a) On or about 2/2/2023, at the site located at 3991 Rose Rd in Batavia, NY;  the employer did not ensure that crew members understood all hazardous positions/locations to be avoided during disassembly operations, such as, but not limited to:  when the crane is moving/rotating, do not stand between the remaining stack of counterweights on the platform of the crane and the passenger side edge of the truck platform. 29 CFR  1926.1404(e)(1): Before a crew member goes to a location that is out of view of the operator and is either in, on, or under the equipment, or near the equipment (or load) where the crew member could be injured by movement of the equipment (or load), the crew member did not inform the operator that he/she is going to that location:   a) On or about 2/2/2023, at the site located at 3991 Rose Rd in Batavia, NY; an employee went to an area out of view of the operator while the crew was in the process of placing counterweights from the crane to a flatbed truck as part of a disassembly operation. Employees were exposed to struck by and crushed hazards when the crane rotated and an employee was out of view of the crane operator.    ABATEMENT DOCUMENTATION REQUIRED

29 CFR 1926.1430(g)(1): Training administration:  The employer did not evaluate each employee required to be trained under this subpart to confirm understanding of the training.  a) On or about 2/2/2023, at the site located at 3991 Rose Rd in Batavia, NY; the employer did not evaluate and confirm each employee's understanding of crane operations training.  Employer's Health, Safety and Environmental Program (HSE Manual) Chapter 14 requires evaluations and audits of their program using templated forms. Employer did not have training records or written evaluations of training being conducted. Employees were exposed to struck by and crushed hazards.  ABATEMENT DOCUMENTATION REQUIRED
